FSU Law decided, apparently between the time I booked our reservation a few weeks ago, and now, that next year they want to start classes at the same time as the main campus, a week later than usual. This has it's benefits for most people. Thanksgiving will no longer be the last weekend before finals, and therefore people will have more of a chance to go home for Thanksgiving. This is because finals will be a week later. Which means that graduation will be a week later, December 16th. This would be entirely insignificant except that I am supposed to be getting married on the 17th. Even if I chose to skip walking, it is still not unlikely that I will have an exam the Friday preceeding, which is the night of the rehearsal, etc. MASSIVELY pissed. And the worst part is that I can't really get upset AT anyone or anything. It is a perfectly logical decision, if you don't have your own wedding that weekend. Now people will actually be able to spend Thanksgiving with their families. The only thing I can really be upset about is that they only published it 13 months in advance, which isn't really something I can bring myself to hate anyone for. Oh well, that'll teach me not to plan 14 months ahead, I guess. Again, furiously livid, but without a goat to scape.

I am registered for classes for next semester now, and excited about what I think is a pretty good schedule. I am taking Women and the Law, which I have wanted to take since I got here, as well as Copyright Law, another that I have been waiting to take. I am also taking Gratuitous Transfers, which should be interesting, its wills and estates and gifts and stuff, and its bar recommended. I'm also taking two other bar recommended classes, Business Associations and Florida Dissolution of Marriage. Oddly, though, the course catalog shows FDM as a two credit course, and the web registration page is showing it as three. Oh well, I am registered and happy about it. Also, I was appointed as an interim Florida State University Student Government Supreme Court Justice today, because they have a case next week and even though my application hasn't gone through yet, they needed a fifth person to have quorum. So that is pretty cool. I hope things are going well for all of you, Peace out, and word to your mothers!

I never thought I would miss USF's administration, but then, I never knew it could be messed up as badly as FSU has. Apparently, everyone registers at the same time, a procedure that, if it were not done electronically, would surely cause a riot. At 8 a.m., they just yell "GO!" and inevitably overload the servers. I woke up at 7:30 to make sure I was ready at 8:00, and was promptly told that I needed to wait ten minutes and try again. After about twenty attempts, the message changed and told me that I had exceeded the maximum number of logins, and that I should call the system administrator. So I did. He told me that this meant that the maximum number of people were on the server at one time. Almost as soon as he started talking I realized that that's exactly what the message meant, but man was it written unclearly. Anyway, I continued trying to log in until 9:00 when I had to leave for class. After class, at 11:00, I finally got into the system. I went to register for my classes finally, and I was baffled to see that they think I owe them money. A lot of money. So I immediately went and tried to figure out why. I went to the site via the link that explicitly stated "click here to see your registration hold" and it said merely "you have a hold because you owe us [a whole lot of money]." This was incredibly redundant and thus not very helpful, so I called the phone number shown on this new screen. I got through, which is the first major obstacle, and was greeted by an automated voice that took me through five or ten minutes of menus, and when it finally transferred me to the office that I presume could have helped me, I received a busy signal. I will now go back and attempt to find another way to figure out why they think I owe them money, because they totally took my tuition out of my loan already. I don't know. Whatever. Hopefully my classes will still be open when I finally wade through the sea of red tape that is currently attempting to strangle me. Peace out, and word to your mothers.

Subject:Yummies and Dummies

Word Up. Earlier this week, Adam took me to The Fresh Market. It was like an amusement park, I could have stayed for hours and spent tons of money. The produce was all good, no looking through the bin for the good apple. The cheese looked like the cheese they use on Food Network. The meat truly looked like works of art, perfectly aged and marbled. We got a couple of beautiful boneless pork chops, which were actually much cheaper than expected (although there wasn't much else that was, which is the main problem with Fresh Market), and we pretty much just seasoned and baked it, and it was incredible. We also tried making saganaki, which is fried feta cheese. I first had it in Greece, and it was really good. Our version, left something to be desired. The cheese, mostly. It had seeped out of the breading, leaving the sticks mostly hollow. They still tasted good, because feta is pretty strong, so just the little bit that stayed in flavored it well.
Yesterday I started exercising again, and it was of course. . . challenging. I then tried playing some music again; I am hoping to get back into it. I finally sent some of the old False Impression bass tabs to Jarred and Angela (if you didn't get them, let me know). And I went to bed before midnight for the first time in at least a few months. Also, this past weekend was a lot of fun, it was great to see everyone at the party.
Now for the dummies part. I just read a case this morning where the US Supreme Court, in 1982, decided that a defendant's silence can be used to attempt to show his guilt, if the silence occurs before they read him his Miranda rights (and also, therefore, before they begin interrogating him). So it's ok to arrest someone, not say anything to them, take them to jail, read them their rights, and interrogate them, and then at trial say that because a normal person would have told the arresting officers that he was innocent, this guy must be guilty. Regardless of whether that would ever convince a jury, assuming someone is guilty because they didn't say that they weren't just doesn't sit right with me. I'm in my second week of classes, and I am really enjoying them. I am taking Evidence, Intellectual Property I (Patents and Trademarks), Immigration Law, Bioethics and the Law, Alternative Dispute Resolution, and Law and Literature. This is 18 credit hours, which I have been informed is absolutely insane, but Law and literature is pass/fail with no exam, so it's really like taking 16 hours with some extra reading, that so far, is enjoyable. The standard hours per semester is only 15, so 16 isn't terribly outrageous. Anyway, the classes are interesting, and much smaller than last year, which is good, since it keeps me on my toes a little more, forces me to do all my reading all the time, since the odds are significantly higher of getting called on. Anyway, enough about my classes. It's going to be a long weekend, which is awesome. I'm excited about people coming up, especially Erin. I can't wait for this weekend. I hope things are going well for everyone else, and that if anyone has family in Louisiana or Mississippi area, that they are safe. Peace.

Word up. Finals are in full swing, but I just had to share this. On the outside of a letter to "RESIDENT - TO A FRIEND" was printed the following message with apparently random underlining; "God said, 'I was to loan you this to start turning things around for you... so here it is. Use it and be blessed.'" Apparently God is now in the loan sharking business. Just one more person exploiting God for their own personal gain. At first I laughed hysterically, but later I realized that it was mostly funny in that "not funny but you pretend it is so that you can sleep at night," way. Oh well, back to the books. Word to your mothers!

Subject:Finals coming and "Fun Game"

Well, finals are coming up in like a week and a half, so I will be studying in the near future. That's about all I have to say I guess, which is probably why I haven't updated lately. We have been discussing some interesting things in my Con Law II class. So far we have discussed abortion, equal protection (including affirmative action), and on Monday started on 1st amendment free speech. So it has of course included much debate, even about topics we didn't actually cover, but just happened to come up, such as legalization of marijuana (medical and otherwise) and the classic formalist (reads the words of the constitution exactly as they are written) against pragmatist (essentially figures out how they want the case to come out and then find the clauses that support that conclusion) argument. Most, of course, are somewhere between the two extremes. Anyway, it has bee an interesting class. Feel free to respond with your side of any of these arguments, or by popular demand (from my brother) with a picture you found in google images for the first word you thought of when thinking about me.

P.S. I am amused because I am writing this in class, and someone's cell phone just went off. The funny part is that they then left the room, assumably to answer it, and left the phone in their bag, in the classroom.

So I was in line waiting to see Star Wars last night, and one of the guys I was with asked an intriguing question. Bad guys never when even though usually they have everything going for them. So, the question was, can you, in under a minute, name three movies where, definitively, the bad guy wins. The time restriction seems daunting, but I got two. Even after the time limit though, it was hard to find any more, because anti-heroes don't count. I did eventually think of a third, that was pretty good, but brought about the question of what "winning" is. I'm not mentioning which one's I thought of because I don't want to ruin anyone else's ideas. So, movies where someone who is definitively bad, definitively wins. No time limit. Enjoy.

So, I am no longer a first year law student. Awesome. I don't have my grades back yet. Less awesome. My classes for the summer are incredibly interesting, and hold my attention for hours at a time, which is especially awesome since they are hours long, and back to back. One of them is fascinating for pragmatic reasons, the other, for the ethical and legal questions it raises. Hopefully the summer courses will lead to my graduating early, which would be, of course, awesome. I start on Thurs. at Firehouse Subs, which will hopefully be awesome, having a paycheck and free food working in favor of awesomeness, and only the possible complications of working with future in-laws working against it's awesomeness. I am going to read the Lord of the Rings throughout the summer, starting with the Hobbit, because I have realized through discussions with "hobbit-heads" that the movies I saw were vastly different from the movies they saw. I have actually contemplated writing a script for the movie I saw, because while it's very plot was completely different, it made sense, and I really did enjoy it. Hey there. Sorry I was gone so long, but after spring break I had a fourteen page brief due on why someone's lawyer falling asleep was not grounds for a re-trial, and I am now writing this in between portions of my take home test on when the government has to reimburse you for taking your property away from you, or restricting your use of it, and when they don't. Anyway, a friend at school introduced me to his, um, label? He promotes rappers, and the way he describes it is that they are trying to bring back rap that contains words with more than one syllable. I checked it out, and it was really cool. I like most rap that says something other than "I got bitches and I got ho's, Platinum rims on the bentley when my crew rolls" and the like. Anyway, it's really cool, and you should all check them out at www.Dubbdis.com Anyway, the other thing that I wanted to say was that, I don't know if you guys already talked about this, because I have missed alot, but they are changing the Florida self-defense laws (disclaimer - what follows is merely my own understanding, and I am not a lawyer yet). Currently, if someone enters your house, you cannot shoot them unless they are in some way threatening you, because if they are just taking your property, well, there's a difference between taking someone's life and taking someone's property. It will now say, starting like, Oct. 10, that anytime someone is in your house unlawfully, you can kill them. Additionally, outside of the home, if someone is threatening you, currently, you must first exhaust all escape routes, and if you end up backed in a corner, then you may use an amount of force necessary to get away from them to defend yourself. As of this Oct. 10, any time anyone has a reasonable fear of an imminent threat, they can use lethal force to defend themselves, even if the threat is not of lethal force. Bars are going to become very dangerous places. Also, since there only has to be a fear of a threat, and not an actual threat, Florida is going to become a very dangerous place for certain groups that are feared more than others. Especially with the current effort to depose the courts (after the Schiavo situation), who I would otherwise say would keep this law reasonable by helping define "reasonable fear", "imminent", and "threat". Anyway, I just thought that you should all know that this was happening. It has passed both Florida houses, and the only thing that would stop it now is a veto from Jeb, and he has said that he plans to sign it. It's good to be back to the LiveJournal, although upcoming finals may make it difficult to continue keeping up. Good to see you all again. Peace out, word to your mothers!

Word up all. It's been a crazy couple of weeks. I am not sure what to tell you guys. Not much has happened, except that I wrote a four page paper, and I played some Halo, taught Adam to play Overpower, exercised with my DDR pad (which is a lot more of a workout than it seems), and watched a five hour documentary on the history of Hip-Hop, which was absolutely fascinating. I am ecstatic about the fact that my spring break starts this weekend. Anyway, just an update. I'll talk to you all later, hopefully I'll see you next week during break. Word. Sorry about the complete lack of anything lately. I was working all last week on my application to the bar, and will be working all this week on my appelate brief. It is only the rough draft, so it only has to be four pages, but there is mad research to do before I can even start writing. And I have a confession to make. I came home this weekend and didn't really tell anyone. I spent the weekend with family and Erin, but I should see friends over spring break in two weeks. It was a crazy weekend. And now, it is business as usual. Just chillin' in the law lounge. Waiting for class to start. Thinking about how I want to get back into music. I started reading a book on copyright law last night, for fun. It's cool though, it's educational, but it's not like a textbook. And even if it was written like a normal textbook, that would be pretty welcome because of the way law books are written. Summer courses won't be posted until March, but I did find out the graduation requirements. As suspected, in order to get out a semester early, I have to take about a semester (15 hrs.) of classes over the summer, or on top of my other classes in other semesters. Although, it's really only 13 hrs that I have to spread out, because the total number of hours is 88, and 15 hrs. over 6 semesters would be 90. Anyway, the cool part is that I can take any classes offered after my first year. There are only two required classes left after the first year, giving me about 54 hours of whatever I want. I am excited about taking Wills, Civil Rights, Church and State, International Human Rights Law, Bioethics and the Law, Copyright Law, First Amendment, Law and Psychiatry, Prostitution and Pornography Seminar, Sports and the Law, Diversity Law, etc. I may have to stay the full three years just to be able to take all the classes I want to take. Just kidding. Anyway, I have to get to class. Peace out, word to your mothers.

I know I just updated before class, but my Supreme Court tour isn't until one o'clock. And yes, I realize my own lame-itude. So anyway, I loves me some string cheese. I haven't had it in years, but when Erin was here, we got some for my bagged lunches that I am supposed to be bringing to school with me. But in the mornings I am always rushing, so today is only the second day that I have remembered to make a lunch to bring. And it's yummy. And it feels like I will have less heartburn from this lunch for some reason. Anywho... last night I was all kinds of productive. I did laundry so that I will have something to wear this weekend, and I exercised (a little). I even "cooked" an almost healthy dinner. It was chicken caesar salad, but I did have to cook the frozen chicken tenders. I also watched "Interview with the Vampire" which is a great movie, though creepy in some spots. I watched The Simpsons and American Idol. Now, I don't usually watch American Idol, but at the beginning when they have all the horrible people auditioning, it's actually pretty entertaining. Last night, there was a mime on. She pretended to sing Aerosmith, which she indicated on a notecard. It was hilarious. Then I watched House. It was really good. Since I don't watch much TV (except for sports and Adult Swim), it's nice sometimes to check in and see what directions it has gone. In fact, the night before last, I watched The Ultimate Fighter. And believe it or not, it was great. It reminded me alot of wrestling, except that all the people there actually wanted to be there, were disciplined, and had heart. Yes heart, the intangible that essentially means refusing to give up. One of the guys lost 20 lbs. in 24 hrs. Is that a good thing to do? Of course not. Is it smart or healthy in any way? Hell no. But it IS a testament to his will. Weight cutting is painful. The most I ever had to do in high school wrestling was like a half a pound in like 4 hrs. I just did some jogging and spat alot. It was interesting though. No one could ever expect him to win a match after that, right? Not exactly. He was thinking about the match for two days straight. The other guy was two pounds under; the night before he was thinking about what he wanted for dessert. The guy who cut weight may have been in a bad condition physically, he knew that he didn't want all of the pain that he had put himself through to be for nothing, and had more drive. The guy who cut twenty pounds won by knockout in the second round of a three round match. He was focused, and he wanted it more. Also, it was interesting to look at the website afterwards. For example, the guy who cut all the weight, Bobby, is a 34 year old UPS driver with two kids who loves to read Tolkein. Anyway, I have rambled enough for one day. Peace out, word to your mothers!

Subject:More Crazy Laws (Entertainment Purposes Only)

Well, I have been learning law for a while now, and it gets more interesting everyday. For instance, Navigation Servitude. The Commerce Clause of the Constitution has been expanded, interpreted, etc. to say that the federal government can seize any navigable waterways for any purpose relating to the promotion of interstate commerce. They do not have to compensate you at all, unless they also take the land surrounding the waterway. Even then, they need only pay you the price of regular land, rather than waterfront property. Additionally, even if your water is not navigable, the government can divert the water on your property to anywhere that they deem it necessary to "promote interstate commerce," leaving your water a dirty muddy trench. Additionally, any point on a beach below the mean high-water mark is considered a public highway (in FL, TX, OR, HI). However, there was a Florida case in which someone ran over a sunbather and claimed that the guy shouldn't have been sunbathing on a highway. The court ruled that that particular highways primary and most effective use to the public was sunbathing (and other beach-like activities), and as such, the sunbather was in the right. Additionally, it is one of the primary objectives of the supreme court to get out of actually addressing an issue as long as is possible. The entire class up to this point has been on all the different ways that the court does this. This is apparently so that the court can have the most possible facts when they finally do rule on whether a law is constitutional, and know how the law is applied, etc. This is known as the Ashwander Rule, and has been in effect since 1936. On an interesting note, the Ashwander Rules make nearly everything that the USF Supreme Court tried to do while I was there blatantly unconstitutional. I'm sure that you have all heard me ramble on about adverse possession already. You know what else is funny? "Time is of the essence" is actually a legal term, and unless it is in the contract, the deadlines therein are not legally binding (unless of course meeting those deadlines is expressed as necessary in another way, for instance if you are to install hurricane shudders, and don't finish until half way through hurricane season). Disclaimer - I am only a first year student in law school and not a lawyer. Please do not use this as legal advice trying to convince your boss that you don't have to meet your deadlines. This clause is mostly used in construction. Additionally, Florida is an employment at will state, and your boss can fire you at anytime, for anything, assuming it's not discriminatory. Firing someone for trying to convince you that your deadlines don't apply is not considered discrimination. Also, traditionally, if you missed a payment, a car payment for instance, they could sue you and hold you in default only for that one payment. However, more recently, they have been putting in clauses that as soon as you miss one payment, your payments accelerate so you owe most if not all of your payments immediately upon defaulting on the one. Additionally, Capital One was specifically mentioned by my professor for giving people very low rates on credit, with a caveat in the contract that if the person ever misses a payment, then the rates immediately jump to 28%. Again, first year student. Haven't checked any of these facts out myself, so don't depend on them. These are just things that I have been told by professors. For all I know, they are wrong or I have misunderstood them, or whatever. These incomplete bits of complicated law doctrines are for entertainment purposes only. The one thing I do know for sure is that if you ever have any legal issues at all, get a real lawyer, preferably a good one. Seriously. Finally, a humorous anecdote from one of my professors. He was buying a house, in Bradenton by the way, and they told him that they had "overlooked" something on his credit report. He still owed $60 to a department store credit card in Denver. He explained that his ex-wife had made the purchase after they were divorced, and that he had no intention of paying it. They laughed at him. He did not laugh. They did not believe that he would prevent the house deal from going through over $60. He informed them that it was the principle of the matter and got up to leave. As he reached the door, they said "Wait! What if we paid it for you?" He told them that that would be fine. I guess their commission was more than $60. I thought that was funny, but I must now go to my Criminal Law class, then I get to go on a tour of the Florida Supreme Court's courthouse! Can't wait to come home this weekend! Guess what. It's early. Anyway, Erin's brother Jason just got Xbox Live, so I played Halo with him last night. Unfortunately he had to play in one of the worst games I've ever played. Not that I played badly, but we had a couple jerks on our team who were intentionally losing, they would take the flag that we were trying to capture and throw it in the ocean, and then laugh and taunt us. That was lame-a-riffic. I got to teach Jason how to leave negative feedback though. Anyway, today I heard that Erin got her Publix internship which is the BIZZOMB. So excited for her. Anyway, I have lunch with a professor today, which should be interesting to say the least. I really don't know what in the world we are supposed to talk to him about, but at least the rest of my study group will be there too. Anyway, peace out, word to your mothers.

It is not horrifically early anymore, but that's mostly because of the drive. I left my place at 7:40 today and got to class a couple minutes before 8:20. That kind of sucks in itself because the drive is usually only 15-20 minutes. But in addition to the horrible rush hour traffic, it was 22 degrees in Tallahassee this morning. Anyway, I get to class a couple minutes before 8:20, and find that it is canceled. I don't have another class until 10:30. It is now 8:40. I should be sleeping. I went to check my e-mail, maybe it's my fault for not checking the night before, no e-mail. I love this professor, but that is not cool. So now I am just sitting here in the student lounge, thinking about Bahn Thai, which, though it tasted excellent, was just not Lai Thai. First and foremost, the crab rangoon was made with cream cheese rather than curry. There was a weird guy singing karaoke the whole meal, and our waitress, an older asian lady (assumably Thai, I guess) kept trying to discuss football with us because the Pats/Steelers game was on. They promised us that next time we came we would be able to use the karaoke machine, because the mechanic(?) showed up to fix it during our meal. But if it was broken then how was the creepy guy using it when we came in? Anyway, Bahn Thai's food was excellent and I plan to go back. Probably often. But Lai Thai is like an old friend. Heck, the waiters and waitresses are old friends now. So many great memories there. Like when James told the waiter he wanted double thai hot because he was working up to triple thai hot, and the guy gave him triple thai hot. We all laughed hysterically, even the waiter, except for James who cried, but then laughed. I think that was the first and last time I saw that particular waiter, actually. And Erin and my first valentine's day together. And the fact that they know my order before I sit down. Erin's too. Pad Sa Eew for me, and Kao Pad Rum for her, with an appetizer of crab rangoon (the curry kind). And when Omar blew his nose in the hot towel after the meal. "Omar!" cried Mary. "I forgot." replied Omar. Forgot what, Omar, forgot what? I wasn't even there for that one I don't think, but every time we go, the story comes up, and it has become a part of the Lai Thai experience. When you move to a new place you try to find another person to be your friend, and hope the friendship is just like the one you had with your best friend back home, but of course it is not. But it is still good in it's own special weird karaoke guy way. I have been lucky in Tallahassee to find old friends, Adam and Jannelle. It has been wonderful seeing them again.
With regard to Lai Thai's detractors, I cannot speak for Jasmine Thai. I have not been there, but plan to in the future, mostly for the sake of this argument. However, regardless of how good Jasmine Thai is, Lai Thai is still magnificent. Even if Jasmine Thai is the best food on the planet, causing spastic, uncontrollable orgasms upon contact with the tongue, Lai Thai is still exquisite. The matter of which is better is of course merely opinion, and is kind of a silly argument at that, since Erin has been to Jasmine Thai, and has informed me that the same people work both restaurants. So while, for all I know, Jasmine Thai could be food of the gods, or taste like pine tar on fiber glass, I know for sure that for me, Lai Thai has excellent food, pleasant atmosphere, and friendly service. And to me, it's more than a restaurant, it's an old friend.

Not much is up actually. I'm alive. I'm reading Law School stuff, playing Halo online. Kind of slow considering the whirlwind pace of winter break. However, Erin came up last weekend. And by weekend I mean from last Wednesday until yesterday morning, Tuesday. It was awesome to be able to spend time with her. But alas, she had to go home. Again. Anyway, FSU beat Wake Forest last night. At basketball. Crazy. Wake Forest is (was) number three in the nation. I have been getting massive quantities of OverPower cards in the mail recently due to an eBay binge a couple weeks ago. The prices were so low! Probably because nobody wants them. Is it too early to be attempting to regain lost youth? Lastly, I received a mass mailing to all of the law students inviting me to join an honors fraternity, they aren't anything like regular fraternities are they? I am excited that my grade that would mean something if it were my final grade can now actually be something, most likely only used for resume building, but something nonetheless. Well, peace out, word to your mothers.
